Synopsis of Web Accessibility Requirements
Section 508 requires Federal agencies to ensure that individuals with disabilities who are members of the public or Federal employees have access to and use of electronic and information technology (EIT) that is comparable to that provided to individuals without disabilities, unless an undue burden would be imposed on the agency. The requirements of Section 508 apply to an agency’s procurement of EIT, as well as the agency’s development, maintenance, or use of EIT.
The Department of Justice has taken the position that both State and local government websites and the websites of private entities that are public accommodations are covered by the ADA. In other words, the websites of entities covered by both Title II and Title III of the statute are required by law to ensure that their sites are fully accessible to individuals with disabilities. An agency with an inaccessible website may meet its legal obligations by providing an alternative accessible way for citizens to use the programs or services, such as a staffed telephone information line. Our alternative accessible way provides an equal, if not superior, degree of access in terms of hours of operation and the range of options and programs available.
